1. Agreement and eligibility
These Terms of Service (the “Terms”) govern your access to trysonggift.com and the SongGift service (“SongGift”, the “Service”, “we”, “us” or “our”). By using the Service or placing an order, you confirm that you have read these Terms and our Privacy Notice and agree to be bound by them.
You must be at least 18 years old and legally able to enter into a contract. If you use SongGift for an organisation, you confirm that you have authority to bind it. Mandatory rights that apply to you as a consumer are not excluded by these Terms.
2. The Service
SongGift turns a story and musical preferences into personalised lyrics and AI-generated music. You can review and edit the words before paying. A standard order is intended to include two full initial versions, selection of one final song, one subjective style adjustment requested within seven days and before final locking, twelve months of online listening, and a revocable gift link.
A correction of a confirmed name, fact or technical defect is separate from the subjective style adjustment. The exact product, price, delivery scope and any optional upgrade shown at checkout form part of your contract and take priority if they are more favourable to you.
3. Access and account security
SongGift uses your email address, a browser session and one-time sign-in codes instead of a traditional password. You are responsible for keeping your inbox, sign-in codes, order links and gift links secure. Tell us through Help & contact if you believe somebody has accessed an order without permission.
Provide an email address that you control and accurate order information. We may ask for reasonable evidence before changing the contact address on an existing order, but we will never ask for your full card number or password.
4. One-time orders, prices and payment
- Every SongGift order is a separate one-time purchase.
- There is no subscription, trial conversion or automatic renewal.
- The total price, currency and any applicable taxes are shown before you leave for Stripe’s secure checkout.
- Stripe processes the card payment. SongGift does not receive or store your full card number or card security code.
The current promotional base price is US$27.99, reduced from US$34.99. The optional download and permitted-commercial-use upgrade is US$8.80 when it is available. Prices may change for a future order, but never after you have authorised the displayed amount for an existing order.
5. Immediate creation and delivery
Music creation begins only after payment is confirmed and after you actively request immediate performance. Delivery times are estimates because the Service depends on third-party AI and cloud systems. We mark an incomplete paid order as delayed after 15 minutes. After 30 minutes without delivery you may request an undelivered-order refund; if it remains unfulfilled after 24 hours, we initiate a refund automatically.
The twelve-month listening period starts when both initial music versions are ready. Adjustments do not restart it. The order page shows the applicable end date. A gift link may be revoked by you or disabled when the hosting period ends.
6. Cancellation, refunds and faulty content
If the law where you live provides a cancellation right, nothing in these Terms removes it. When you expressly ask us to begin a personalised service during a cancellation period, the law may allow us to charge a proportionate amount for work already performed. Any loss of a cancellation right for supplied digital content applies only where the legal requirements—including your express consent and acknowledgement—have been met.
We refund verified duplicate charges, amounts taken without a valid order, and undelivered orders under section 5. Content that is faulty, materially misdescribed or does not conform to the contract is handled under applicable consumer law; those rights are not consumed by the style adjustment. A change of taste after conforming personalised work has been delivered is not by itself a fault.
Refunds are returned to the original payment method. Banks and card networks control when the returned funds appear. If only an optional upgrade is refunded, a valid base order remains available. Start a request from your order page or Help & contact.
7. Your story, instructions and permissions
You keep the rights you already hold in the text, memories, names and other material you submit (“Input”). You give SongGift a limited, non-exclusive licence to host, copy, adapt and send the Input to our processors only as needed to create, deliver, secure and support your order.
You confirm that you have the rights and permissions needed to provide the Input and to use any person’s name, private details or likeness in the way you request. Do not submit highly sensitive information that is unnecessary for the song. You are responsible for reviewing the lyrics and correcting names, facts and pronunciation before payment.
8. AI generation and rights in the song
SongGift uses third-party AI services, including Kie.ai and an underlying Suno music-generation workflow. Results can be unexpected, may resemble elements of other works by coincidence, and may not qualify for copyright protection in every country. We do not promise exclusivity, copyright registration, streaming platform acceptance or Content ID eligibility.
To the extent SongGift owns or is permitted to grant rights in a delivered output, the base order gives the buyer a personal, non-exclusive right to listen and share through the provided gift page during the hosting period. Downloading and commercial use are permitted only when you purchase an available upgrade and the order receipt or licence expressly lists that use. A licence cannot grant rights that our upstream providers do not grant.
The commercial-use upgrade stays unavailable whenever supplier rights have not been verified. See the Usage Rights page for the current scope and exclusions.
9. Acceptable use
You must not use SongGift to create, submit or distribute content that:
- is illegal, fraudulent, threatening, hateful or seriously abusive;
- sexually exploits or endangers a child;
- infringes copyright, trade marks, privacy or publicity rights;
- impersonates a real person, clones a voice, or falsely suggests that a real artist or person created or endorsed the song;
- contains malware, attempts to defeat safeguards, or disrupts the Service;
- is scraped or collected at scale to train or benchmark a competing model without written permission.
You may describe a broad genre, mood or era, but must not request an imitation likely to mislead people into believing a named living artist performed the output. We may reject an Input, disable sharing or suspend access when reasonably necessary to enforce these rules, protect people or comply with law. 11. Privacy and service providers
Our Privacy Notice explains the information we use and your choices. Cloudflare supports hosting, storage, security and transactional email; Stripe processes payments; Kie.ai and the underlying music workflow process the creative instructions needed to generate a song; and Mixpanel receives privacy-filtered product events only if you allow optional analytics.
12. Availability and changes
We provide the Service with reasonable care and skill, but do not promise uninterrupted availability or a particular creative outcome. We may change or retire features for security, legal, supplier or operational reasons. Changes do not remove rights you already have in a paid order. If a material change prevents us from fulfilling a paid order, we will provide an appropriate remedy, which may include a refund.
13. Suspension, deletion and termination
You may request deletion from your order page. This removes access to the creative content, although we may retain limited transaction, consent, fraud-prevention and dispute records where law or a legitimate legal need requires it. We may suspend or terminate access for a serious or repeated breach, fraud, a security threat or a legal requirement. Where practical, we will explain the reason and offer a way to appeal.
14. Warranties and liability
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or your mandatory consumer rights. SongGift is not a music-law, copyright-clearance or professional advisory service.
If you use the Service for business purposes, then to the maximum extent permitted by law we are not liable for indirect or consequential loss, lost profit, lost business or lost data, and our aggregate liability relating to an order is limited to the amount you paid for that order. This business limitation does not apply where prohibited by law or to consumer remedies that cannot be excluded.
15. Complaints, governing law and disputes
Please contact us first through your order page or Help & contact so we can investigate. These Terms do not prevent a consumer from using an applicable alternative dispute-resolution service, complaining to a regulator or bringing a claim in a court available under mandatory local law.
The governing law and the legal identity and postal address of the operating business will be displayed before live checkout opens and on the purchase record. Until that launch information is complete, SongGift does not offer live checkout. Consumers retain any mandatory protection of the country in which they normally live.
16. Changes and contact
We may update these Terms as the Service changes. The version accepted for a paid order remains recorded with that order. Material changes will be announced on the site or by email where appropriate and will not apply retroactively in a way that removes existing rights.
